SOLE AGENCY AGREEMENT
FOR PROFESSIONAL RENTAL AND/OR SELLING SERVICES SUPPLIED BY
OnlyInSamui.Com (Known hereafter as the Company)
The Owner hereby instructs the Company to place the property on The Gold List or The Platinum List (see below) at the pre-agreed renting and/or selling price as detailed below. The Owner further agrees that the Company can promote the renting or selling of the property with whatever promotional package prices they require providing that the agreed fixed prices as detailed below are returned to the Owner without any commission being deducted.
Period: This agreement will stay in force for a period of TWELVE months from receipt of this signed contract. Should the Owner decide to withdraw at any time during that period, he / she must give TWO months notice in writing.
The Company agrees to provide a rental assessment and/or selling valuation if requested by the Owner and advise on any course of action required to maximise the renting potential and the selling potential.
Commission Due: There are NO commissions charged. If, after termination of the contract, the owner rents out the property to someone who was introduced by the Company during the period of the contract, a commission of 15% of the total rental price becomes due and payable.
The Company will use the following marketing strategies:
b) Make full use of the Company-owned website advertising (updated daily). Use local press advertising at our discretion. Place a poster in the property grounds (returnable upon end of contract or £25 charge will be applied).
c) Ensure that the rental particulars are not misleading or unlawful. Accept a security deposit on the Owner’s behalf (£500) to cover any damage occasioned during renting the property.
d) The owner understands that the Company operates a marketing policy whereby media reviewers will be invited to stay at the property as non paying guests in order for the property to obtain independent reviews – this is deemed essential to the successful marketing of same. Also provided under this clause without charge to the Owner are full-time security agents and professional house sitters whose attendance will provide the property with added security. In all instances whether paying guests or not, all utilities or expenses to be paid by the Company.
The Owner understands that the Company is not responsible for the security or maintenance of the property during the period of this agreement when the Company or their renters are NOT in attendance. The Owner understands that those services, while available, are charged extra and can be negotiated separately.
It is deemed that the Owner has accepted the above terms and conditions by the act of sending this Agreement via electronic tranmission to the Company who will acknowledge receipt of same by return. Once the Company has checked that all details are correct and acceptable to the Company under the terms of the Gold List or Platinum List - then the Owner will receive a further email confirming acceptance whereby the Agreement comes into force.
